Terms of Use

These Terms explain the rules for using PainSignal, including account use, subscriptions, AI-generated outputs, third-party source data, and usage limits.

1. Acceptance of Terms

These Terms of Use govern access to and use of PainSignal, operated by Pain Signal. By creating an account, subscribing, accessing, or using PainSignal, you agree to these Terms. If you do not agree, do not use the service.

2. Description of Service

PainSignal is an AI-powered market research and SaaS idea discovery platform. It helps users search market signals, analyze complaints, review product launches and public discussions, generate SaaS ideas, create Deep Opportunity Reports, run Competitor Gap Searches, use Opportunity Radar, create Idea Validation Scorecards, save ideas, and export reports as PDFs.

The service is a research and productivity tool. It does not guarantee that any idea, report, score, recommendation, niche, market, or strategy will be accurate, profitable, legally compliant, or commercially successful.

3. Eligibility

You must be old enough to use online services in your jurisdiction and legally able to enter into these Terms. If you use PainSignal on behalf of a company or organization, you represent that you have authority to bind that organization.

4. Accounts

  • You are responsible for keeping your account credentials secure.
  • You must provide accurate account and billing information.
  • You may not share, resell, rent, sublicense, or transfer account access unless PainSignal expressly allows it.
  • You are responsible for activity that occurs under your account.
  • You must notify us if you believe your account has been compromised.

5. Subscriptions and Billing

PainSignal may offer free and paid plans with different features, usage limits, and source access. Payments are processed through Stripe. By subscribing to a paid plan, you authorize recurring charges according to the selected plan until you cancel.

Subscriptions may renew automatically. You can manage or cancel billing through the available billing controls. Unless required by law or expressly stated otherwise, fees are non-refundable. We may change plans, prices, features, or limits, but we will try to provide reasonable notice for material changes where practical.

6. Usage Limits

Plans may include limits for searches per month, signals or complaints per search, generated ideas, saved ideas, reports, Competitor Gap Searches, Opportunity Radar tracked niches, radar scans, Idea Validation Scorecards, source access, and other product features.

We may enforce, modify, throttle, suspend, or limit usage to protect the service, comply with provider requirements, prevent abuse, or maintain product quality. Attempting to bypass limits is prohibited.

7. AI-Generated Content Disclaimer

PainSignal uses AI systems, automated analysis, public source analysis, and third-party model providers to generate outputs. Outputs may be inaccurate, incomplete, misleading, outdated, biased, or unsuitable for your specific situation.

You are solely responsible for reviewing, validating, and deciding whether to rely on any output. PainSignal does not guarantee business success, revenue, investment outcomes, product-market fit, user demand, competitive advantage, or the accuracy of any generated idea, report, score, or recommendation.

PainSignal does not provide financial, legal, investment, accounting, tax, medical, or other professional advice. You should seek qualified professional advice where appropriate.

8. User Content

You retain ownership of content you submit to PainSignal, including keywords, descriptions, manual complaints, idea briefs, notes, and feedback. You grant PainSignal a worldwide, non-exclusive, royalty-free license to host, process, analyze, reproduce, display, transmit, and create outputs from your content as needed to provide, secure, support, and improve the service.

You represent that you have all rights needed to submit your content and that your content does not violate law, third-party rights, confidentiality obligations, platform terms, or these Terms. Do not submit illegal, harmful, malicious, highly sensitive, or regulated content unless you have the right to do so and it is appropriate for the service.

9. Public and Third-Party Source Content

PainSignal may retrieve, analyze, or summarize data from public or third-party sources, including Reddit, Product Hunt, GitHub Issues, App Store, Google Play, Hacker News, Stack Exchange, Trustpilot, YC Signals, OPUS Search or broad web search, and manual imports. PainSignal does not own or guarantee third-party source content.

You are responsible for respecting third-party terms, copyrights, privacy rights, and other legal restrictions when using insights, exports, or generated outputs based on source content.

10. Prohibited Use

  • Use PainSignal for illegal, deceptive, harmful, or abusive activity.
  • Scrape, overload, attack, disrupt, or abuse the service or connected providers.
  • Reverse engineer, copy, resell, rent, sublicense, or commercially exploit the platform itself without permission.
  • Bypass authentication, security controls, subscription limits, usage limits, rate limits, or source restrictions.
  • Upload malicious code, harmful content, or content that violates third-party rights.
  • Use outputs to violate laws, platform rules, privacy rights, intellectual property rights, or contractual obligations.
  • Misrepresent AI-generated outputs as guaranteed facts or validated professional advice.
  • Use the service in a way that creates unreasonable load on PainSignal, AI providers, source providers, or infrastructure.

11. Intellectual Property

PainSignal owns the platform, software, design, workflows, branding, interface, code, documentation, and other service materials. These Terms do not transfer any ownership in PainSignal or its intellectual property.

Subject to these Terms, you may use generated outputs for your own internal research, product evaluation, business planning, and related commercial work. You may not copy, clone, resell, or repackage the PainSignal platform or present the service itself as your own.

12. Service Availability

PainSignal is provided on an as-available basis. We do not guarantee uninterrupted, error-free, secure, or permanent availability. Features may change, providers may fail, sources may block requests or return no data, and some functionality may be unavailable due to maintenance, limits, or third-party issues.

13. Beta and Early-Stage Features

PainSignal is an early-stage product and some features may be experimental, incomplete, or subject to change. Reports, radar scans, validation scorecards, and competitor analysis are research aids, not guarantees.

14. Termination

We may suspend, restrict, or terminate access if you violate these Terms, fail to pay, create risk for the service, misuse sources or providers, attempt to bypass limits, or use PainSignal in a harmful or unlawful way. You may stop using the service at any time.

15. Limitation of Liability

To the maximum extent permitted by law, PainSignal and Pain Signal will not be liable for lost profits, lost revenue, lost data, business interruption, product decisions, investment decisions, reliance on outputs, third-party source issues, provider failures, or indirect, incidental, consequential, special, exemplary, or punitive damages.

Where liability cannot be excluded, the total liability of PainSignal and Pain Signal will be limited to the amount you paid to PainSignal during the three months before the event giving rise to the claim, or the minimum amount permitted by applicable law.

16. Indemnification

You agree to defend, indemnify, and hold harmless PainSignal, Pain Signal, and their owners, operators, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your content, misuse of the service, violation of these Terms, violation of law, or violation of third-party rights.

17. Governing Law

These Terms are governed by Hungary, without regard to conflict of law rules. Any disputes will be handled in the courts or forum permitted under that governing law, unless applicable law requires otherwise.

18. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised last updated date. Continued use of PainSignal after changes become effective means you accept the updated Terms.
